This Microsoft Research end user license agreement ("MSR-EULA") is a legal agreement between you and Microsoft Corporation (?Microsoft? or ?we? or "us") for any copies of the pre-release software identified above and any associated materials, which includes any associated media and "online" or electronic documentation but does not include source code (together, the "Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this MSR-EULA. If you do not agree, do not install, copy or use the Software. The Software is protected by copyright and other intellectual property laws and is licensed, not sold. A. LICENSE GRANT Upon your agreement to the terms of this MSR-EULA below, you may install one (1) copy of the Software on your personal computer and use such copy at no charge for non-commercial purposes, such as the experimentation, research, teaching and general exploration of the Software and its functionality. In addition, you may reproduce and distribute the following portion of the Software: Msbn3.dll (editing and inference engine); MSBNProp.ocx and probedit.ocx (property and state editing control); MSBNProp.ocx (standard assessment control); Asym.ocx (asymmetric assessment control); bagset.dll (associative array component); dtasmnu2.dll (popup menu); ShowProp1.dll (Show the property pages of an ActiveX control at run time); M3Logger.dll (Log all editing on a model); AutoDistLib.dll (add-in that gives a distribution to new nodes); HMMAddinLib.dll (Hidden Markov Model add-in); and reorderparentslib.dll (add-in to reorder the parents of a node) (together, the "Redistributable Code"), provided that you comply with all of the following redistribution limitations: (1)?You will distribute the Redistributable Code only in its entirety without modification, and only in conjunction with and as part of your program application created through the use of the Software under this MSR-EULA (your "Application"); (2)?Your Application adds significant and primary functionality to the Redistributable Code; (3)?You do not distribute the Redistributable Code for profit or as part of any commercial product; (4)?You retain all Microsoft copyright and trademark notices with the Redistributable Code; (5) You include a reference in the Application's About Box that a portion of the Software is included; (6)?You will not use Microsoft's logo as part of, or to market, your Application, and any use of Microsoft trademarks shall comply with the guidelines in http://www.microsoft.com/trademarks/ (or any successor location); (7)?You will include your valid copyright notice in your Application and an end user license agreement that is consistent with the terms of this MSR-EULA; (8) Any sublicense granted by you for use of the Redistributable Code does not permit further redistribution of the Redistributable Code; and (9)? You shall indemnify, hold harmless, and defend Microsoft from and against any claims or lawsuits, including attorneys? fees, that arise or result from the use or distribution of your Application, except to the extent any such claim is based on the Software as provided to you by Microsoft. All rights not expressly granted in this MSR-EULA are reserved to Microsoft. B. DESCRIPTION OF OTHER LICENSE LIMITATIONS. In return for the lincese grant to the Software, we ask that you agree to all of the following: (1) You will not copy, sell, rent, lease, distribute, sublicense, assign, or otherwise transfer (including by loan or gift) the Software and will not attempt to modify it, or to reverse engineer or decompile it, except and only to the extent authorized. (2) You will not use the Software in a live operating environment where it may be relied upon to perform in the same manner as a commercially released product, or with data that has not been sufficiently backed up. (3) You will leave in place all copyright notices that you might find in the Software. (4)?Microsoft requests but does not require that you include a citation for the Software, as a courtesy, in any articles written for academic or research publications concerning your use of the Software, its inclusion in your Application, or related matters. (5) Any feedback about the Software provided by you to us is voluntarily given, and we shall be free to use the feedback as we see fit without obligation or restriction of any kind, even if the feedback is designated by you as confidential. (6) You may disclose the results of Software benchmark tests or comparative analyses, provided that you disclose that the Software is an unsupported beta tool used for research purposes, and may contain errors and bugs that Microsoft is not obligated to correct (7) The Software comes ?AS IS? with all faults and with no warranties, conditions or representations, including but not limited to the implied warranties of merchantability and fitness for a particular purpose, or any warranty against interference with your enjoyment of the Software or against infringement. The entire risk as to satisfactory quality, performance, accuracy, and effort is with you. There is no warranty that this Software will fulfill any of your particular purposes or needs. (8) We have no duty of reasonable care or lack of negligence and that we are not obligated to (and will not) provide technical support or updates for the Software. (9) We will not be liable for any damages, including those known as direct, indirect, special, consequential, or incidental damages related to the Software or this MSR-EULA, nor any damages for negligence, to the maximum extent the law permits. (10) If you sue or threaten to sue anyone over patents that you think may apply to the Software or if you breach this MSR-EULA in any way, your license to the Software ends automatically. (11) This MSR-EULA shall be construed and controlled by the laws of the State of Washington, USA, without regard to conflicts of law.
